2. What Information We Collect
We collect only the information that is necessary to respond to your enquiry or to carry out the service you have engaged us for. This may include:
- Contact details — your name, email address, and phone number when you complete a contact form or reach us by telephone.
- Enquiry content — the nature of your estate matter as you describe it when first getting in touch.
- Estate and document information — details shared during the course of a consultation or engagement, which may include information about the deceased, beneficiaries, or property.
- Website usage data — anonymous technical information such as pages visited and browser type, collected via cookies. See our Cookie Policy for details.
3. How We Use Your Information
Your information is used only for the purposes for which it was provided. Specifically:
- To respond to your enquiry and, if relevant, schedule an initial consultation.
- To carry out the legal services you have asked us to provide.
- To send you a written summary or update relating to your matter.
- To meet our obligations under Thai law, including record-keeping requirements.
- To improve how our website functions, using aggregated, anonymous usage data.
We do not use your personal information for marketing purposes without your clear permission, and we do not sell or trade your data to any third party.
4. Legal Basis for Processing
We process your personal data under the following bases, in accordance with Thailand's Personal Data Protection Act (PDPA) B.E. 2562 (2019):
LEGITIMATE INTEREST
To respond to your enquiry and provide preliminary information about our services.
CONTRACTUAL NECESSITY
To fulfil the services set out in any engagement agreement between you and Maradok Trust.
LEGAL OBLIGATION
To comply with Thai legal requirements, including those relating to legal practice and record retention.
CONSENT
Where we send you optional communications or use non-essential cookies, we will ask for your permission first.
5. How Long We Keep Your Information
Enquiries that do not progress to an engagement are held for up to twelve months, after which they are deleted. Where you become a client, we retain your file for ten years following the close of your matter, in line with standard legal practice requirements in Thailand. You may request deletion at any time; we will advise you if a legal obligation prevents us from complying immediately.
6. Sharing Your Information
We share your information only when it is necessary to provide the service, or when we are required to do so by law. This may include:
- Thai courts, the Land Department, or other government bodies when representing you in estate proceedings.
- Other parties involved in the estate matter, such as co-executors or notaries, when required for your case.
- Trusted service providers who assist with our website or communications, operating under strict data processing agreements.
No information is transferred to parties outside Thailand without appropriate safeguards in place.
7. Your Rights
Under the PDPA, you have the right to:
- Know what personal data we hold about you and request a copy.
- Ask us to correct any inaccurate or incomplete information.
- Request that we delete your personal data, subject to our legal obligations.
- Object to processing based on legitimate interest.
- Withdraw consent at any time, without affecting the lawfulness of processing carried out before the withdrawal.
To exercise any of these rights, please write to us at [email protected]. We aim to respond within 30 days.
