Terms & Conditions

The basis on which Maradok Trust provides its services

These Terms and Conditions set out the basis on which Maradok Trust provides inheritance legal services. We have written them to be as clear and straightforward as possible. By engaging our services or using our website, you are agreeing to these terms. If you have any questions before proceeding, we welcome you to contact us directly — we are happy to go through anything that is unclear.

1. About These Terms

These Terms and Conditions apply to all use of the Maradok Trust website at maradoktrust.blog and to all services provided by Maradok Trust (registered at 105 Huay Kaew Road, Suthep, Chiang Mai 50200, Thailand).

Where a separate written engagement letter or service agreement is in place, that document will govern the specific engagement. These Terms apply to all matters not addressed by such an agreement.

2. Our Services

Maradok Trust provides the following inheritance legal services to individuals and families:

Estate Overview Consultation — ฿1,490

A structured consultation to review the estate and explain the steps ahead, with a written summary provided following the session.

Will and Records Support — ฿2,640

Assistance with understanding a will and organising related estate records, including document review and ongoing updates.

Estate Matter Representation — ฿4,070

Representation in contested estate proceedings, with full document handling and ongoing support throughout the matter.

Service fees quoted are starting fees. The scope and pricing of each engagement is confirmed in writing before work begins. Fees are quoted in Thai Baht and are subject to applicable taxes.

3. Engaging Our Services

A service engagement begins when you receive and accept a written confirmation from Maradok Trust outlining the scope of the service and the applicable fee. Submitting a contact form or making an initial enquiry does not in itself constitute an engagement.

We assess each matter individually before confirming whether we are able to assist. We reserve the right to decline an engagement at our discretion, and will advise you promptly if we are unable to take on your matter.

4. Fees and Payment

The fee for each service is confirmed in the engagement letter sent to you before work begins. Payment terms are as follows:

  • For consultations, payment is due prior to or at the time of the appointment.
  • For ongoing services, a deposit may be requested at the commencement of the engagement, with the balance due on completion or at agreed milestones.
  • Additional work that falls outside the agreed scope will be discussed with you before it is undertaken, and a separate fee confirmed in writing.

We do not proceed with chargeable work without your prior written agreement on fees.

5. Cancellations and Changes

We understand that circumstances can change, particularly during difficult family periods. Please notify us as early as possible if you need to cancel or reschedule an appointment.

  • Appointments cancelled with more than 48 hours' notice will not incur a cancellation fee.
  • Appointments cancelled with less than 48 hours' notice may result in a partial fee to cover preparation time already expended.
  • If we need to reschedule for any reason, we will notify you as soon as possible and offer an alternative date without additional charge.

6. Our Responsibilities to You

We commit to providing our services with care, competence, and respect for the sensitivity of your situation. Specifically, we will:

  • Keep you informed of progress on your matter in a timely manner.
  • Treat all information you share as confidential, subject to our legal obligations.
  • Provide written summaries or updates as specified for each service.
  • Act in your best interests, within the bounds of Thai law and professional obligations.

7. Your Responsibilities

To enable us to assist you effectively, we ask that you:

  • Provide accurate and complete information about the estate and your relationship to it.
  • Share relevant documents promptly when requested.
  • Notify us of any changes in your circumstances that may affect your matter.
  • Pay agreed fees in accordance with the payment terms in your engagement letter.

8. Limitation of Liability

While we take care to provide accurate and considered advice, the outcome of any estate matter depends on factors outside our control, including decisions made by courts, government bodies, and other parties. We cannot accept liability for outcomes that result from inaccurate or incomplete information provided to us, or from circumstances beyond our reasonable control.

Our liability for any claim arising from a service engagement is limited to the fees paid for that specific engagement. Nothing in these Terms limits our liability for fraud, gross negligence, or any matter that cannot be excluded under Thai law.

9. Website Use

The information on our website is provided for general guidance only and does not constitute legal advice. Each estate situation is different, and you should not rely on website content as a substitute for professional advice specific to your circumstances.

We make reasonable efforts to keep our website accurate and up to date but cannot be responsible for errors or omissions. Links to third-party websites are provided for convenience; we are not responsible for their content.

10. Governing Law

These Terms are governed by the laws of Thailand. Any dispute arising from or related to these Terms or our services shall be subject to the jurisdiction of the courts of Chiang Mai, Thailand.

11. Changes to These Terms

We may update these Terms from time to time. Any changes will be reflected by an updated date at the top of this page. We encourage clients to review these Terms periodically. Engagements entered into before a change in Terms remain governed by the Terms in force at the time of engagement, unless both parties agree otherwise in writing.
